1. Acceptance of Terms

Welcome to Fluffy Paws Pet Care (operating as Fluffy Paws or "we," "us," "our"). By accessing or using our website (the "Site"), booking any of our services (including dog daycare, boarding, training, or any other pet care services), or otherwise interacting with our business, you ("Client," "you," "your") agree to be bound by these Terms of Use ("Terms") and our Privacy Policy.

If you do not agree with any part of these Terms, you may not use our Site or services.

2. Eligibility and Accounts

2.1 Age and Capacity

You must be at least 18 years old and capable of entering into a legally binding contract under the laws of Ontario, Canada. By using our services, you represent and warrant that you meet this requirement.

2.2 Account Registration

• You may need to create an account to book services. You are responsible for maintaining the confidentiality of your login credentials.
• You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
• You are solely responsible for all activities under your account. Notify us immediately if you suspect any unauthorized use.

3. Services, Orders, and Contracts

3.1 Services Offered

We offer various pet care services, including but not limited to:

• Dog Daycare: Daytime supervision and socialization
• Dog Boarding: Overnight care
• Dog Training: Behavioral training sessions
• Other Services: As described on our Site or in communications with you

3.2 Booking Process

• When you book a service through our Site or by phone/email, you are making an offer to purchase that service.
• We reserve the right to accept or decline any booking at our discretion, including for reasons of capacity, pet health concerns, or behavioral issues.
• Once we confirm your booking (via email or other communication), a binding contract is formed between you and Fluffy Paws Pet Care.

3.3 Service Descriptions

We strive to provide accurate descriptions of our services. However, we do not warrant that all descriptions are complete, current, or error-free. If a service is not as described, your sole remedy is to discontinue the service (subject to our cancellation and refund policies).

4. Payments and Billing

4.1 Pricing

• All prices are in Canadian Dollars (CAD) and are subject to change without notice.
• The price you pay is the price displayed at the time of booking confirmation (unless an obvious pricing error has occurred, in which case we will notify you).

4.2 Payment Methods

• We use Stripe as our payment processor. By providing payment information, you authorize us (or our payment processor) to charge your selected payment method.
• Payment is typically required at the time of booking or according to the payment schedule agreed upon (e.g., monthly packages).

4.3 Taxes

Prices may be subject to applicable federal and provincial taxes (e.g., HST). Taxes will be added at checkout as required by law.

4.4 Late Payments

If payment is not received by the due date, we reserve the right to suspend services until payment is made. Late fees may apply as outlined in your service agreement.

5. Cancellations and Refunds

5.1 Dog Daycare

• Notice Period: Cancellations must be made at least 24 hours before the scheduled daycare date.
• Refunds:
  • Cancellations made 24+ hours in advance: Full refund or credit toward future services
  • Cancellations made less than 24 hours in advance: No refund (full charge applies)

5.2 Dog Boarding

• Notice Period: Cancellations must be made at least 3 days before the scheduled check-in date.
• Refunds:
  • Cancellations made 3+ days in advance: Full refund or credit
  • Cancellations made less than 3 days in advance: Maximum 50% refund

5.3 Dog Training

• Notice Period: Cancellations must be made at least 48 hours before the scheduled training session.
• Refunds:
  • Cancellations made 48+ hours in advance: Full refund or credit
  • Cancellations made less than 48 hours in advance: No refund (full charge applies)
• Training Packages: Unused sessions in a pre-paid package may be refunded on a pro-rata basis if the package is canceled more than 7 days before the next scheduled session. Otherwise, no refunds for partial packages.

5.4 Weekly Daycare Plans

• Notice Period: Cancellations for individual days within a weekly plan must be made at least 24 hours before the scheduled date.
• Refunds:
  • Cancellations made 24+ hours in advance: Unused days are refundable
  • Cancellations made less than 24 hours in advance: Unused days are not refundable

5.5 Exceptions

We may, at our sole discretion, waive cancellation fees in cases of genuine emergencies (e.g., pet illness verified by a veterinarian, family emergencies). Contact us as soon as possible to discuss your situation.

5.6 Our Right to Cancel

We reserve the right to cancel or refuse service at any time if we determine that your pet poses a risk to other animals, our staff, or our facility, or if you violate these Terms. In such cases, we will provide a refund for any prepaid, unused services.

6. Pet Health and Safety Requirements

6.1 Vaccinations and Health Records

• All dogs must be current on required vaccinations, including:
  • Rabies
  • DHPP (Distemper, Hepatitis, Parvovirus, Parainfluenza)
  • Bordetella (Kennel Cough)
• You must provide proof of vaccination (from a licensed veterinarian) before your pet's first visit and keep records up to date.
• Pets must be free of contagious illnesses, external parasites (fleas, ticks), and internal parasites at drop-off.

6.2 Behavioral Assessment

• All dogs must pass a behavioral assessment (meet-and-greet) before being accepted for daycare or boarding.
• Aggressive behavior (toward people or other pets) may result in immediate dismissal without refund.

6.3 Spay/Neuter Policy

Dogs over 7 months of age must be spayed or neutered to participate in group daycare or boarding (exceptions may be made on a case-by-case basis; contact us to discuss).

6.4 Disclosure of Health Issues

You must disclose any known health conditions, allergies, dietary restrictions, medications, or behavioral issues. Failure to disclose relevant information may result in immediate dismissal and no refund.

7. Emergency Care and Veterinary Authorization

7.1 Authorization

By using our services, you authorize Fluffy Paws Pet Care to seek emergency veterinary care for your pet if, in our reasonable judgment, such care is necessary. We will attempt to contact you first, but if you are unreachable, we will proceed with treatment.

7.2 Veterinary Expenses

• You agree to reimburse us for any veterinary expenses incurred on behalf of your pet, including emergency treatment, diagnostics, medications, and hospitalization.
• We may require a credit card on file or a deposit to cover potential emergency expenses.

7.3 No Liability for Veterinary Decisions

We are not veterinarians and do not provide medical advice. We will use our best judgment in selecting a veterinarian and making decisions in an emergency, but we are not liable for any veterinary care, treatment, or outcomes.

8. Drop-off, Pick-up, and Late Fees

8.1 Operating Hours

Our standard hours of operation are posted on our website and may vary by service. Please adhere to scheduled drop-off and pick-up times.

8.2 Late Pick-up Fees

• If you are late picking up your pet, a late fee of $10 per 15 minutes (or as otherwise posted) will apply.
• Repeated late pick-ups may result in termination of services.

8.3 Extended Stays

If you fail to pick up your pet within 24 hours of the scheduled pick-up time and we cannot reach you, we may treat the situation as pet abandonment and take appropriate action, including contacting animal control or rehoming the pet. You will remain financially responsible for all accrued charges.

9. Acceptable Use Policy

When using our Site or services, you agree NOT to:

• Provide false or misleading information about your pet's health, behavior, or vaccination status
• Harass, threaten, or abuse our staff or other clients
• Use our services for any unlawful purpose
• Attempt to gain unauthorized access to our systems, networks, or data (including other users' accounts)
• Interfere with the proper functioning of our Site (e.g., hacking, distributing malware, spamming)
• Reproduce, duplicate, or resell any part of our Site or services without written permission

Violation of this policy may result in immediate termination of services and legal action.

10. User Content and Photo/Video Release

10.1 User Content

If you submit content to our Site (e.g., reviews, testimonials, photos), you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, and display that content for business purposes (including marketing and promotional materials).

10.2 Photo/Video Release

• By using our services, you consent to Fluffy Paws Pet Care taking photos and videos of your pet during their stay.
• You grant us permission to use these photos/videos on our website, social media, and marketing materials unless you explicitly opt out in writing.
• We will not share your personal contact information publicly with these images (though your pet's name may be included).

10.3 Opting Out

If you do not wish for your pet's image to be used, please notify us in writing at support@fluffypaws-petcare.com.

11. Intellectual Property

11.1 Our IP

All content on our Site—including text, graphics, logos, images, software, and design—is the property of Fluffy Paws Pet Care or our licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

11.2 Limited License

You are granted a limited, non-exclusive, non-transferable license to access and use our Site for personal, non-commercial purposes. You may not:

• Modify, copy, distribute, or create derivative works from our content without written permission
• Use our trademarks, logos, or branding without authorization
• Remove any copyright or proprietary notices

12. Disclaimers and Limitations of Liability

12.1 No Warranties

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability or fitness for a particular purpose
• Warranties that our Site or services will be uninterrupted, error-free, or secure
• Warranties that your pet will not become ill, injured, or experience behavioral issues while in our care

12.2 Limitation of Liability

To the maximum extent permitted by law:

• Fluffy Paws Pet Care (and our owners, employees, and agents) shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services or Site.
• Our total liability for any claim related to our services shall not exceed the amount you paid for the specific service giving rise to the claim.

12.3 Assumption of Risk

You acknowledge that pet care services involve inherent risks, including the risk of:

• Injury, illness, or behavioral changes to your pet
• Transmission of contagious diseases despite vaccination
• Interactions with other animals that may result in minor injuries

By using our services, you voluntarily assume these risks.

12.4 Exceptions

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Ontario law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Fluffy Paws Pet Care (and our owners, employees, and agents) from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to:

• Your use of our services or Site
• Your violation of these Terms
• Your pet's behavior or actions (including injuries to other pets, people, or property)
• Any false or misleading information you provide

14. Termination

14.1 By You

You may stop using our services at any time. If you have a prepaid package or subscription, cancellation and refund terms will apply (see Section 5).

14.2 By Us

We may suspend or terminate your access to our services (and your account) at any time, with or without notice, if we believe you have violated these Terms or engaged in conduct that is harmful to our business, other clients, or pets in our care.

14.3 Effect of Termination

Upon termination, you must immediately pay any outstanding fees. Sections of these Terms that by their nature should survive termination (including indemnification, disclaimers, and dispute resolution) will remain in effect.

15. Dispute Resolution and Governing Law

15.1 Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

15.2 Jurisdiction

Any legal action or proceeding arising out of or relating to these Terms or our services shall be brought exclusively in the courts located in Toronto, Ontario, and you consent to the jurisdiction of such courts.

15.3 Informal Resolution

Before filing a lawsuit, we encourage you to contact us at support@fluffypaws-petcare.com to attempt to resolve the dispute informally.

16. Electronic Communications and Notices

By using our Site or services, you consent to receive communications from us electronically (via email or through the Site). You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Notices to you may be sent to the email address you provided during registration. Notices to us should be sent to support@fluffypaws-petcare.com.

17. Third-Party Links and Services

Our Site may contain links to third-party websites or services (e.g., Stripe for payment processing). We are not responsible for the content, privacy practices, or terms of use of third-party sites. Your use of third-party services is at your own risk.

18. Feedback and Suggestions

If you provide us with feedback, suggestions, or ideas about our services, you grant us the right to use and implement such feedback without any obligation to compensate you or provide attribution.

19. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to causes beyond our reasonable control, including but not limited to:

• Natural disasters (floods, fires, earthquakes)
• Government actions or regulations
• Pandemics or public health emergencies
• Labor strikes or disruptions
• Utility or telecommunications failures

In such events, we will make reasonable efforts to notify you and resume services as soon as possible.

20. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms at any time (e.g., in connection with a merger, acquisition, or sale of assets).

21. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

22. Entire Agreement

These Terms (together with our Privacy Policy and any other policies referenced herein) constitute the entire agreement between you and Fluffy Paws Pet Care regarding the use of our Site and services, and supersede all prior or contemporaneous agreements, communications, and proposals (whether oral or written).

23. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will post the updated version on this page and revise the "Effective Date" at the top.

Material Changes: For significant changes, we may also provide additional notice (e.g., via email or a prominent notice on our Site).

Your continued use of our services after any changes constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using our services.
